Terms of Service
Last updated 8 October 2026
Pre-launch draft, pending legal review
1. Who we are and what this agreement is
These Terms of Service ("Terms") are an agreement between you and CRITIXFIT LIMITED, a company incorporated in Hong Kong (company number 81235804) ("CritixFit", "we", "us"). They apply to the CritixFit website at critix.fit, the web app at app.critix.fit, our mobile apps, our watch app, the coach voice calls offered on our website, and every other service we run under the CritixFit name (together, the "Service").
By creating an account, or by using the Service in any other way, you agree to these Terms, to our Privacy Policy, to our Medical Disclaimer and to our Cookie Policy. The Medical Disclaimer is part of these Terms. If you do not agree, please do not use the Service.
These Terms are written in plain English on purpose. Headings are there to help you find things and do not change the meaning of a clause.
2. The Service
CritixFit is a training service for people who walk, run, ride, swim or lift. It builds a training plan from your answers and your history, reads the data you connect from your phone and your watch, shows you your workouts, and lets you talk with four AI coaches by chat and by voice. It also includes a community where members can share workouts, a strength library, tools such as a race time predictor and a route finder, and short games.
CritixFit is a coaching and tracking tool. It is not a medical service, it is not a medical device, and it does not replace a doctor, a physiotherapist, a dietitian or a therapist. Please read sections 5 and 6 and the Medical Disclaimer before you train.
CritixFit is opening to new people in small groups, by invitation. Some features may be in beta, may change, or may not be available in every country or on every device. We may add, change or remove features. If we remove something you paid for, we will tell you and, where the law requires it, give you a fair remedy.
3. Your account
- You need an invitation to create an account while CritixFit is invite-only.
- You must give us true and current information, and keep it up to date. Your plan is only as good as the answers behind it.
- One account is for one person. Do not share your login, and do not create an account for someone else without their permission.
- You are responsible for keeping your login safe and for what happens under your account. If you think someone else has used it, tell us at [email protected] straight away.
- You may delete your account at any time in Settings. Section 19 explains what happens next.
4. Age and who the Service is for
You must be at least 16 years old to use CritixFit, or older if the law where you live sets a higher age for agreeing to this kind of service. CritixFit is not for children, and we delete an account when we learn that it belongs to someone under 16.
CritixFit is designed for healthy adults. If you are under 18, please use it only with the knowledge of a parent or guardian and with the advice of a doctor if you have any health concern.
5. Health, fitness and your own risk
CritixFit gives general training information for educational and informational purposes. It is not medical advice and not a medical device. Please read the Medical Disclaimer, which is part of these Terms.
Physical exercise carries a risk of injury, illness and, rarely, death. You choose whether, when, where and how hard to train. You take part in any activity, including following a CritixFit plan, workout, route or coach suggestion, at your own risk. You confirm that you are physically able to train, or that a doctor has said you may.
Before you start, and whenever your health changes, talk to a doctor, especially if you have or had a heart condition, chest pain, dizziness, an injury, a medical condition, or take regular medication, or if you are pregnant, recently gave birth or have a history of disordered eating. Stop and get help if something feels wrong. Nothing a coach says can replace advice from a qualified professional who knows you.
Your plan is a suggestion. You can change it, skip a session or stop at any time. Doing so is always your decision.
6. AI coaches
CritixFit's coaches, plans, feedback, voice calls and predictions are produced by artificial intelligence, including models from third-party providers. The coaches are not people. They have names, faces and voices so that they are easy to talk to, but they do not have a body, a licence or a duty of care like a human professional.
AI has known and unknown limits. A coach may be wrong, out of date, incomplete or unsuitable for you, and it can sound sure when it is wrong. You use AI features at your own risk. Check anything important with a qualified professional, and do not rely on a coach for medical, legal, financial or safety decisions.
Do not give the coaches information about other people. Do not use a coach to get content that could harm you or someone else. Two people can get different answers to the same question, because answers depend on the data we hold about each person and on how the AI works.
The coaches are not a crisis service and are not watched by people in real time. If you or someone else is in danger, call your local emergency number. Read more on the AI safety page.
7. Location, routes and safety
You accept the safety, security and privacy risks of recording, following or sharing GPS activities and routes. Suggested routes may be inaccurate, closed or unsafe. They may cross roads, private land or places that are not safe at your hour or in your weather. Check every route yourself.
Obey local laws and traffic rules, stay aware of your surroundings, and never use the app where it would distract you dangerously. Do not look at your phone while you run, ride or swim unless it is safe to do so. If you share a map, other members can see where you started and where you went.
8. Devices, data and accuracy
CritixFit uses data from your phone, your watch and third-party services. We do not control them. We do not promise that their data, or the numbers we work out from it (including heart rate, HRV, sleep, readiness, training load, calories and race predictions), are accurate, complete or on time. Heart rate from the wrist is less accurate than from a chest strap, and GPS can drift.
The HRV measurement with the phone camera is a training guide. It is not a health check, and it does not measure blood pressure or blood oxygen.
9. Third-party services
You can connect services such as Garmin, Suunto, Polar, Wahoo, Strava, Apple Health, Google Health and Spotify. They have their own terms and privacy policies, and we are not responsible for them, for how they use your data, for their availability, or for changes they make. You can disconnect a service at any time in Settings. Our sub-processors page lists the companies that handle data for us.
10. Prices, subscriptions and cancellation
Some parts of CritixFit may be paid. When they are, these rules apply:
- Before you pay, we show the price, how often you are charged, that it renews automatically until you cancel, and how to cancel.
- You can cancel online at any time in Settings, under Subscription (web), or in your app store account (App Store and Google Play purchases). Cancelling stops the next renewal. You keep access until the end of the period you paid for.
- We remind you before each yearly renewal.
- If we change a price, we tell you in advance, and the new price applies from your next renewal. You can cancel before then.
- EU and UK consumers: you may withdraw within 14 days of buying. If you asked us to start straight away, we may keep an amount for the days you used.
- Purchases made through the App Store or Google Play follow that store's payment and refund rules, and the store is the merchant of record. Purchases on the web are processed by a payment provider named on our sub-processors page. Prices may include taxes where the law requires.
11. What you post, and what we may do with it
You keep the rights to the content you add to CritixFit, such as workouts you share, photos, videos, comments and messages. You are responsible for it, and you promise that you have the right to post it and that it does not break the law or anyone's rights.
By posting content in the community or sharing a workout, you give us a free, worldwide licence to host, store, display and share that content inside the Service, to the audience you chose, for as long as it is on the Service. This licence ends when you delete the content or your account, except for copies that other people have already received and for backups that expire on their own.
Your messages to a coach are used to answer you and to make your coaching better for you. We describe this in the Privacy Policy.
12. Community rules and moderation
The community is for people at every level to cheer each other on. Be kind. You are responsible for what you post. We may remove content and block accounts that break these Terms or put people at risk. You can block a member and report a reply with the report button, or write to [email protected]. We look at reports and act on them, and we may keep a record of what was reported.
13. Acceptable use
Do not misuse the Service. In particular, you must not:
- share other people's health data or personal details;
- harass, threaten, impersonate or discriminate against anyone, in the community or in chat;
- use CritixFit for anyone else's training without their permission;
- try to make the coaches produce harmful content, or try to get around their safety rules;
- attempt to break, probe or overload the Service, its security or its rate limits;
- copy, scrape, reverse-engineer or resell the Service, the coaches or our content;
- upload malware, or content that is illegal, hateful, sexual or violent; or
- use the Service in a way that breaks any law.
14. Our rights
CritixFit, its software, design, coaches, texts, images, videos, voices, training methods and other content are owned by us or by our licensors and are protected by law. We give you a personal, limited, non-exclusive, revocable licence to use the Service for your own training, under these Terms. We keep all other rights. Your data remains yours, and you give us the licence needed to run the Service for you.
If you send us ideas or feedback, we may use them without having to pay you or credit you.
15. The Service as it is
The Service is provided "as is" and "as available". We work hard to keep it running and accurate, but to the fullest extent the law allows we do not promise that it will be uninterrupted, error free or suitable for your goal, that a plan will get you a certain result or finish time, or that data will never be lost. A projected finish time is an estimate, not a promise.
This section does not limit rights that the law gives you as a consumer and that cannot be waived.
16. Limit on our liability
To the fullest extent the law allows: (a) we are not liable for indirect, incidental, special or consequential loss, or for loss of data, profit or goodwill; and (b) our total liability for all claims about CritixFit is limited to the greater of USD 50 or the amount you paid us in the 12 months before the claim.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by our negligence, for fraud, or your statutory rights as a consumer.
17. Release (US users only)
If you live in the United States, you release CritixFit and its officers, employees and partners from claims arising from your athletic activities, to the extent permitted by law. This section does not apply to people in the EU, the UK or anywhere else where such a release is not allowed.
18. If your actions cause us a loss
If you are not a consumer, or where the law allows it, you will cover the reasonable losses we suffer because you broke these Terms or the law, or because of content you posted. This does not apply to consumers where the law does not allow it.
19. Ending your account
You may stop using the Service and delete your account at any time in Settings. When you delete it, we erase or irreversibly anonymise your personal data as described in the Privacy Policy, subject to limited legal retention, and copies in backups disappear as the backups rotate, within 30 days.
We may suspend or close an account, with a reason where we can give one, if you break these Terms, put others at risk, or if the law requires it. We may also stop the Service or a feature; if we do, we will tell you in advance where we reasonably can. Sections that by their nature should continue, such as 14 to 18 and 20 to 22, continue after your account ends.
20. Governing law and disputes
In general: these Terms and any dispute about CritixFit are governed by the law of Hong Kong, and the courts of Hong Kong can hear them, except as set out below.
Consumers anywhere: if you are a consumer, nothing in these Terms takes away the mandatory consumer protection rules of the country where you live.
EU and UK consumers: if you are a consumer in the EU or the UK, you keep the consumer protection rules of the country where you live, and you may bring a claim in the courts of that country. Nothing here takes those rights away.
US users: any dispute between you and CritixFit is resolved by individual, binding arbitration administered by JAMS under its rules, not in court, except that either of us may bring an individual claim in small claims court. You and CritixFit each waive any right to bring or join a class action or a representative claim. If a court decides that this class waiver cannot be enforced for a claim, that claim goes to court and not to arbitration. You may opt out of arbitration within 30 days of first accepting these Terms by writing to [email protected] with your name and the email on your account. Before either of us starts a claim, we will try for 30 days to settle it informally.
21. Changes to these Terms
We may update these Terms, for example when we add a feature or when the law changes. We will tell you in the app before material changes take effect. When the Terms change in a material way, we ask you to accept the new version. If you do not agree, you can stop using the Service and delete your account.
22. General
- The whole agreement: these Terms, the Privacy Policy, the Medical Disclaimer and the Cookie Policy are the whole agreement between you and us about the Service.
- If a part does not work: if a court finds part of these Terms unenforceable, the rest stays in force.
- No waiver: if we do not enforce a right straight away, we have not given it up.
- Transfer: you may not transfer your account or your rights. We may transfer our rights and duties to a company that takes over CritixFit, and we will tell you if we do.
- Events outside our control: we are not responsible for a delay or failure caused by something beyond our reasonable control, such as a power or network failure, or a failure of a service we depend on.
- Language: these Terms are written in English. If we provide a translation, the English text decides if they differ, except where the law requires otherwise.
- Third parties: only you and CritixFit have rights under these Terms.
